    Pick the right template

    Choose the agreement that matches the work. Don't stretch one template to cover a different kind of deal.

    Fill every blank

    Replace each [__________] with real details: full legal names, ID or company registration numbers, addresses, amounts in rand, and dates. Delete clauses that don't apply.

    Check the money terms

    Confirm deposits, payment days, VAT and cancellation fees match what you quoted. Vague money terms cause most disputes.

    Explain it to the other party

    Give them time to read it. Under the Consumer Protection Act, unfair or hidden terms may not be enforceable against consumers.

    Sign properly

    Both parties sign and date every copy, ideally with a witness. Electronic signatures are valid under the ECT Act for these agreements.

    Keep a copy

    Store signed copies securely for at least 5 years, and handle any personal information in line with POPIA.

When to get an attorney

Contracts above roughly R50 000, anything involving employees (use the BCEA/LRA-specific contracts instead), long-term exclusivity or restraint of trade, licensing of valuable IP, or if the other party sends back heavy changes.
