Freelancers, suppliers, landlords and anyone owed money by a client, tenant or friend

Letter of Demand

A firm, formal demand for unpaid money: the step the Small Claims Court expects before you claim.

Quick answer

A letter of demand is a written agreement used by freelancers, suppliers, landlords and anyone owed money by a client, tenant or friend in South Africa. This template covers exact amount and what it is for, clear deadline (at least 14 days), payment details and reference, interest at the prescribed rate and more, drafted with POPIA, the CPA and the ECT Act in mind.

The problem it solves: You've sent WhatsApps and reminders, nothing happens, and you don't know the proper next step.

Do I need a letter of demand before Small Claims Court?+

Yes. The Small Claims Court expects you to have delivered a written demand by hand or registered post, giving the other side at least 14 days to pay, before you lodge your claim.

Does a letter of demand need an attorney?+

No. You can send it yourself. For credit agreements under the National Credit Act a special section 129 notice applies, so speak to an attorney for those.

Is this legal advice?+

No. It's a professionally structured starting point. For high-value or unusual deals, have an attorney review your completed document.
