Finding a commissioner of oaths

An affidavit must be signed in front of a commissioner of oaths. Police officers at most police stations act as commissioners free of charge, and many attorneys, bank officials, post office managers and some accountants are commissioners by virtue of their office. Bring your ID and don't sign beforehand.

Quick answer

Write your full name, ID number and address, then set out the facts in numbered paragraphs in the first person, using only what you know to be true. Leave it unsigned and sign it in front of a commissioner of oaths, who will sign and stamp it.

Step by step

1. Heading: 'Affidavit'. 2. Your details: 'I, the undersigned, [name], ID [number], of [address], state under oath:'. 3. Numbered paragraphs with the facts, dates and places. 4. A closing line: 'I know and understand the contents of this declaration. I have no objection to taking the prescribed oath. I consider the oath binding on my conscience.' 5. Space for your signature and the commissioner's details.

Where to get it commissioned

Any commissioner of oaths: police stations (free), attorneys, and many banks and post offices. Take your ID. The commissioner must see you sign.

Common mistakes

Signing before you get there, leaving blanks, using hearsay ('I was told') without saying so, and adding opinions instead of facts.
