Lease agreement template South Africa: what it must include (2026)

Quick answer

A South African residential lease should name the landlord and tenant, describe the property, set the rent, escalation, deposit and lease period, and record both parties' duties. Under the Rental Housing Act 50 of 1999, the tenant may demand a written lease, and the landlord must hold the deposit in an interest-bearing account and do joint inspections at move-in and move-out.

What a good lease includes

1) Full names, ID or registration numbers and addresses of both parties. 2) The property address and what's included (parking, garden, furniture). 3) Monthly rent, the due date, how to pay and the yearly escalation. 4) Deposit amount and how it is held. 5) Start date and length of the lease, plus renewal terms. 6) Who pays water, electricity and rates. 7) Maintenance and repairs: who fixes what. 8) House rules, pets, sub-letting and occupants. 9) Notice, cancellation and breach. 10) A signed incoming inspection list.

Deposits and inspections

The deposit belongs to the tenant until a valid deduction is proved. Inspect together before the tenant moves in and within three days before they move out, and keep photos. Refund within 7 days if nothing is owed, or within 14 days after repairs are done. Fair wear and tear can't be deducted.

Ending a lease early

Where the tenant is a consumer, the Consumer Protection Act (section 14) lets them cancel a fixed-term lease on 20 business days' written notice, subject to a reasonable cancellation penalty. Landlords must give tenants 40–80 business days' notice before a fixed term ends about renewal. No one may be evicted without a court order under the PIE Act.

Residential or commercial?

Frequently asked questions

Does a lease have to be in writing in South Africa?

No, a verbal lease is valid, but the tenant can demand it in writing under the Rental Housing Act, and a written lease is far easier to enforce.

How much deposit can a landlord ask?

The law sets no maximum. One to two months' rent is common. Whatever the amount, it must earn interest for the tenant.

Can I cancel my lease early?

If you're a consumer, yes: 20 business days' written notice under the CPA, but the landlord may charge a reasonable cancellation penalty.

Can a lease be signed electronically?

Yes. The ECT Act recognises electronic signatures for leases. The ECT Act excludes only very long leases of land (over 20 years), which need wet-ink signatures.

Is a free lease template good enough?

It is a solid starting point for a standard rental. For unusual properties, large deposits or disputes, have a South African attorney review it.
